I have booked a flat on the second floor of an apartment building within city limits. It has ground and four floors. When I applied for a loan, the bank rejected it saying the apartment does not have permission for the fourth floor from the BBMP. The builder has shown me the Khata of the fourth floor which is already sold. Please advice.

You will have to check the plan sanctioned for the building. If the plan does not sanction the fourth floor, it will be an illegal construction and granting of the Khata will not make it legal. The bank would also be concerned that the building will not have the occupancy certificate. I have booked a flat in Bangalore and site plan has been approved by the erstwhile zilla panchayat in 2004-05. Up-to-date tax has been paid and accepted by BBMP since February 2009. The developer is not inclined to submit a second approval by BDA/BBMP saying that the ZP approval will be ratified by BBMP as soon as the flats are ready for possession by December. Is this in order?
