We have approximately a 40x80 feet site in AP while we live in Bangalore. My father who owns the land is dead and my maternal uncle has been taking care of the plot for many years. There are no legal documents. We want to sell the land but our uncle is not willing to give it to us. He says we can have a right on the land on the condition that his daughter should be married to my brother. Recently, we came to know that his daughter is getting married to someone else. How do we get back our land?

You should first get all the papers. If the sale deed is registered in the name of your father, you will be able to get the sale deed from the sub-registrar's office concerned. This confirms that your father was the owner of the plot. On this fact being established you should make the necessary application for the mutation Khata to be in the name of the legal heirs of your father. Once the Khata is transferred you will be able to deal with the property. If your uncle obstructs, you have to take appropriate legal proceedings.
